4. Information Sharing
We share your information only as described below. We do not sell your personal information.
- State and government agencies: To file the business formation and other documents you have requested.
- Service providers (sub-processors) acting on our behalf: Companies that process your information only on our instructions to operate our business, including payment processing, text-message delivery, email and customer-messaging platforms, hosting and infrastructure, and analytics and advertising-measurement partners.
- Advertising and analytics partners: To measure and improve our marketing, we may share limited identifiers, such as a hashed version of your email address or phone number and online identifiers, to measure conversions. California residents may opt out of this sharing (see California Privacy Rights below).
- Legal requirements: When required by law or to protect our rights, our users, or the public.
- Business transfers: In connection with a merger, acquisition, financing, or sale of assets.
Mobile information. We do not share your mobile phone number or your SMS opt-in consent with any third parties or affiliates for their own marketing or promotional purposes. Numbers you provide for text messaging are shared only with our SMS delivery provider, solely to send the messages you requested.
5. SMS / Text Messaging
Your consent. We send text messages only to mobile numbers that have opted in to receive them. When you provide your mobile number and check the SMS consent box during checkout or in your account settings, you agree to receive recurring automated text messages from us at that number. We use a double opt-in process: after you check the box, we send a one-time confirmation text, and we begin sending messages only after you reply to confirm. Consent to receive texts is not a condition of purchasing any product or service.
What we collect for SMS. When you opt in, we collect and store your mobile phone number; the fact that you consented; and the date, time, source (the page or screen where you opted in), and the IP address and device or browser information associated with your opt-in and your confirmation reply. We also keep a record of the messages we send you and their delivery status, and of any opt-out request (for example, if you reply STOP).
What our texts are about. Our text messages are limited to helping you complete a business formation or other filing you started with us, for example a reminder that an application you began is still waiting, which may include a link to finish it and occasionally a promotional discount. We do not send text messages for unrelated marketing. Message frequency varies based on your activity.
Charges. Message and data rates may apply, depending on your mobile carrier and plan.
How to opt out or get help. You can opt out at any time by replying STOP to any of our text messages; we will send one confirmation and then stop texting you. Reply HELP for help, email us at [email protected], or manage your SMS preferences in your account settings.
Who we share SMS data with. We share your mobile number only with our text-message delivery provider, a messaging service provider acting on our behalf, solely to send these messages and process your replies.
We do not sell your mobile number or SMS consent, and we do not share your mobile number or your SMS opt-in consent with any third parties or affiliates for their own marketing or promotional purposes. Mobile information obtained through SMS consent is never shared with third parties for their marketing.
6. Data Security
We use appropriate technical and organizational measures to protect your information, including encryption, access controls, and secure infrastructure. Documents and files you upload to us, and the documents we prepare for your filings, are stored with our cloud storage provider, Google Cloud, on servers located in the United States, and are encrypted both in transit and at rest. No method of transmission or storage is completely secure, but we work to safeguard your information using industry-standard protections.
7. Data Retention
We retain your personal information for as long as necessary to provide our services and comply with legal obligations. We keep your business formation and filing records, and your account, so that your documents remain available to you in your member portal and so we can continue to service and support your filings. We retain SMS consent and opt-out records for as long as needed to honor your preferences and demonstrate compliance. Business formation documents and records may be retained for extended periods as required by law.
8. Your Rights
Depending on your location, you may have the right to:
- Access and receive a copy of your personal information
- Request correction of inaccurate information
- Request deletion of your personal information
- Opt out of marketing communications, including text messages
- Opt out of the sharing of your personal information for cross-context behavioral advertising
