The Process of LLC Application
Most people who form an LLC in Virginia are doing it for one of two reasons: they want legal protection between their personal assets and a business that's actually running, or they're getting ready to sign contracts, hire someone, or take outside money and they want the right legal entity in place first. Both are reasonable triggers, and the LLC handles both well.
The state's process is simple on paper. Corporation Commission accepts the Articles of Organization from new LLCs, you must list a registered agent with a Virginia address on that filing, and you pay the state's filing fee at submission. We prepare and submit the documents in your state's specific format and follow up with the agency until your filing is approved.
What happens after approval is where most owners spend their time. You'll likely apply for an EIN, set up a business bank account, write an Operating Agreement, and check what licenses your industry needs at the local and state level. From there, Virginia's recurring compliance keeps your LLC active, which we cover in the FAQ below.
